-- Abraham Lincoln --In case some of you were wondering why several of my deviations have disappeared from my gallery I've been accused of art theft by a photographer here on DA -- in other words taking her photography and drawing over it -- and despite my protests to the contrary she decided I was lying, she knew better, that no one could recreate her photo down to the smallest detail, etc., etc. I will reiterate, I did not draw over her photograph, I drew it and all the details of it I wished to incorporate into my drawing and then drew over that (which, in effect, is doing what she accused me of

) She reported me to the dAdmins and they, subsequently removed the deviation (although how they managed to delete something I'd already deleted I'm not sure -- does anyone know how they accomplish that?)
This next part is conjecture, as I have no concrete evidence to support my theory (although this nasty little note left on my home page by the photographer stongly points to my theory that she set her friends and watchers to attack me and my gallery as being correct "

Have a nice day!", but following closely upon that first deletion several people began attacking other art in my gallery accusing me again of art theft, one of them going so far as to reply to comments from my viewers that this was done in PhotoShop, it was nothing but me changing the photo to an "oil painting" and claiming it as my work (this despite the fact that my husband
watched me draw at least one of the works in question -- from where he sits at his computer he can see my computer screen clearly. Also -- and this is nit picking on my part -- I DO NOT, and never have used PhotoShop for any of my works so his/her comment that he/she
knows PhotoShop when they see it is patently false). These drawings they found questionable were also reported to DA and, even though I'd already deleted them as well, were once more removed from my gallery

. (By the way, I removed the first drawing because I was disgusted and repulsed by the animosity from the photographer and didn't want anything to do with her or her photograph in my gallery -- the second two I removed because I was tired of being vilified by several persons about them.)
Anyway, I wished to apologize to my watchers, especially those who've added my works to their favorites, and those who've received comments from my attackers -- BUT, I refuse to accept the appellation "Art Thief" and will continue to produce digital art despite the harassment (though I'm pretty sure the harassment will continue).

And that's just an outright nasty way to handle anything like this. If I recognized something from my own gallery in someone else gallery I would first of all send a note and not drag that person in the dirt officially by making comments. That's just childish. A drama queen maybe?
As for deletion here at dA, nothing you delete from your gallery will really go away unless it's deleted in the backend as well. They break their own user agreement that way around here. I believe that if you delete something from your gallery, dA doesn't have any rights to use that deviation for any of their own purpose any more. But it's still on the server.
If you want any photos as a reference for your art btw you are welcome to use any of mine, in either of my galleries.
She strikes me as very childish and vindictive . . . and totally unreasonable. After going around and around with her I finally just deleted my drawing, not because she wanted me to, but because I was thoroughly disgusted with her and her attitude.
Oh, so when I delete something DA still has access to it? Hm, I'm not sure I like that idea.
And thanks for the offer of photos . . . I just may take you up on it. One of her attack dogs made this comment on my user page "If you're only able to do paint-overs then there are plently of ways for you to get the rights to source material for doing paint-overs, matte-paintings, etc.; such as taking the 'reference' photos yourself or sourcing old photos even from your parents/grandparents etc., that you probably have living in old boxes, or purchasing stock photos. All of these you would have the rights to use as you wish and that would not be in violation of the dA guidelines."
If you're only able to do paint-overs my ass. They obviously didn't look at anything else in my gallery

I am sorry but in my opinion what da and the photographer say, is right. I dont, however, know the way they talked to you or spoke to you, but i think that if it was explained to you why this was considered an art theft, you would have understood.

And they protect artists, photographers, writers, etc. You cannot, cannot simply take a photo you've found, and run it through filters, or run a tablet or mouse over it, hell, you can't even crop it, unless the original owner has given you written permission.
In the case of the Temple Dancer piece, for instance. That's a world famous photographer and I highly doubt he wants people altering his work without asking him first. It's not just common sense, it's the law.
How would you feel if someone took something of yours, and then called it their own after altering it in one way or another?
With stock imagery, you're fine, however, not all photographs are stock, and you need to make sure that even if they say stock, that you've got permission (which you have in some of your deviations). There are stock sites and stock photographers that sell their work as stock.
I have no clue who this original photographer is that you're talking about, but if I was the original artist, and my work had been used without permission, I'd be up in arms too.

i just wanted to let you know that i support you too, but i do understand where some of those comments come from. however, they did not need to go through the lengths that they have and attack you like that. hopefully they will stop badgering you soon.
